The long running battle for the Atomic Veterans in their case against the MOD took a new twist today when the Supreme Court, following a day of oral submissions.
The significance of the case steps beyond the clear importance and sensitivity for the veterans themselves, as the matter is a glowing example of how access to justice will be drastically reduced should the MOJ’s proposed reforms to eradicate success fee and ATE premium recoverability be enacted.
Cases such as this simply wouldn’t be capable of being brought in a non-recoverable regime as the veterans are supported by a CFA and an ATE insurance policy brokered by TheJudge.
Denying clients such as this access to risk transfer mechanisms would be an incredible injustice and will ultimately deny many civil litigants and small businesses the opportunity to bring their cases to court against financially strong opponent’s such as the MOD.
